KPI Solutions Co., Ltd. (ACN Ginza building, Ginza 8-15-2, Chuo-ku, 104­-0061 Tokyo, Japan) (hereinafter referred to as “KPI”) is the data controller, offering various marketing and ad related services. As a provider of such services, we deal with large amounts of data. We understand, that data protection and privacy of personal data is important to users of our services, especially when conducting business. The privacy of our customers is of extreme importance to us. This Privacy Policy outlines the types of information which is processed by us via our ADmeme and ADgraph services. It clarifies how and for what purpose we process data and generally gives you and overview of your rights in the data processing.

1. What kind of data we collect

KPI does not collect any personally identifiable information referring to any individual person, such as name, address, gender, age and the like. We do however, collect data referring to the browsing behavior of online devices, such as cookies, IP address, referrer, time, and user agent, as well as Google’s Advertising ID and Apple’s Identifier for Advertisers (IDFA).

2. How we use data

First of all, please let us clarify that our aim is not to collect personally identifiable information (such as name, address or telephone number) about you in order to identify individuals. The data we collect and process is used in order for our customers to be able to provide targeted advertising based on categories of users (such as age-group, location, gender, interests). We do not collect this data directly from users, but base the categorization on various indicators, such as browsing behavior (e.g. a user that browses content which uses our technology and has content referring to cars, camping, fishing and the like, may be categorized as male for the purpose of showing advertisement related to these interests). This process is done completely automatic, based on algorithms and AI that we developed particularly for this purpose. No employee of KPI ever interacts with the raw data collected.

3. How we collect data

KPI uses cookies, web beacons as well as our own developed and managed ID called mID (Mobsmart ID) in order to collect the above-mentioned data:

a. Cookies

Cookies are small text files that are stored on your hard drive assigned to the browser you are using and by which the body that sets the cookie (here through us) receives certain information. Cookies cannot run programs or transmit viruses to your computer. They serve to make the Internet offer more user-friendly and effective overall.
ADmeme does use cookies to store information about customers preferences, record user-specific information on which pages the user access or visit, customize Web page content based on customers browser type. KPI, as a third-party AD vendor, uses cookies to serve ads on ADmeme. KPI’s use of the ADmeme cookie enables it to serve ads to users based on their visit to ADmeme site and other sites on the Internet.
When you visit any website on which KPI Solutions' ADmeme technology is used, our servers will check to see, if you already have the ADmeme cookie. If the servers do not receive the ADmeme cookie, the servers will try to set a cookie in response to your browser's request to view that Web page. If you do not want the ADmeme cookie with a unique value, you can obtain the ADmeme "opt-out" cookie.
OPT-OUT SETTING  

You can configure your browser setting to decline the acceptance of third-party cookies or all cookies. Please be aware, that you may not be able to use all features of the respective website you visit and may also not receive any marketing offers that are relevant to you, if you chose to disallow cookies.

b. Web beacons

A web beacon is graphic pixel image, that is placed on a website to unobtrusively monitor the behavior of the user visiting the website regarding access and use of a website. We do not collect any personal information with this technology.

c. mID

mID is a unique ID that KPI developed and manages. It consists of a combination of cookie, IP address, time, referrer and user agent. mID is not generated by signing up to a specific account, and therefore does not contain any personal information such as name, address, birthday or any other personal identifier.
mID allows us to track the browsing behavior from a specific device in order to place targeted advertisement on websites of business partners that use our services.

4. Purpose of data processing

We collect and process data in order to provide high performance and high-quality marketing services for our customers.

5. Data storage and retention

Our servers are located in Japan. Any data we collect is stored for a maximum of 60 days and is deleted thereafter.

Our Group Companies use data for the same purposes and in line with the privacy principles as laid out in this Privacy Policy. Furthermore, we use certain third-party solutions in order to provide our services. Where we sent data to an entity outside our group companies, we have appropriate contractual safeguards in place to ensure the security and integrity of the data, as well as compliance with the applicable data protection laws.

7. International Transfer

The data we collect may at times be transferred to countries other than your home country. It is possible that those other countries do not offer the same level of data and privacy protection regime as your home country does. However, we always comply with the applicable data protection laws of each respective jurisdiction and have appropriate safeguards in place in order to ensure the security and integrity of the data.

8. Security

We use various methods to safeguard the security and integrity of our data. We have backup and recovery solutions in place to ensure the accessibility of the data at any time. Any data collected via the mID system described above, is encrypted in our system, in order to prevent any unauthorized access to it. Our servers are protected by various industry grade security measures in order to prevent unauthorized access to the data.

10. Your rights under the GDPR

In cases where we collect personal data from data subjects based in the European Economic Area (“EEA”), you have various rights under the General Data Protection Regulation (“GDPR”). In particular, you have the right to request access to and rectification or erasure of personal data, the right to restrict processing or to object to processing, as well as the right to data portability.
